And it’s in the news again. We have Elie Wiesel’s name slated for baptism, baptisms performed for Nazi-hunter Simon Wiesenthal’s parents, baptism performed for Anne Frank (for the ninth time!), baptism performed for Daniel Pearl (who was killed in part, at least, because he was Jewish), and baptism performed for Gandhi. This in spite of the Church’s agreement (in 1995!) to remove Holocaust victims from the database.[fn1] And, apparently, the Church has now sent out a strongly-worded letter to be read in Sacrament meetings.[fn2] In the letter, the Church (strongly) reiterates the prohibition on submitting celebrity and Holocaust victim names, with potential penalties to follow for improper submissions. Will this work? Hopefully.[fn3] But I’ve been thinking about possible ways to police the submissions as a backstop.[fn4] Note that I’m perfectly aware that there is debate over whether we should, as a normative matter, care about others’ perception of baptisms for the dead.[fn5] And there’s debate among those not of our faith about whether proxy baptisms are, in fact, offensive. I have no interest in rehashing those arguments, though. Let’s assume that the Church is serious about its policy statement (which I believe it is), and, just for fun, let’s brainstorm how it can implement the policy. The Bott Gaffe: A Chronology [Updated 6Mar12 9:45p]
Since Wednesday, when I read the Washington Post article that cited BYU Professor Randy Bott, I have been surprised at two elements of the news and commentary I’ve read about it. First, I’ve been pleasantly surprised at the unanimity of the response—no one that I’ve seen has tried to defend the ideas that Bott expressed. Second, I’ve been surprised at the speed of the official response. If it is possible, the response makes the views expressed by Bott seem anachronistic to Mormonism today. And I hope this response will make clear to those who still maintain some version of these racist views that they are no longer tolerated among Mormons.

[Update 2:] The Church has responded, both with respect to Dr. Bott’s statement and with a statement on the Church and race. I’m adding the text of each to the bottom of the post, but I want to highlight these two excerpts: We condemn racism, including any and all past racism by individuals both inside and outside the Church. The origins of priesthood availability are not entirely clear. Some explanations with respect to this matter were made in the absence of direct revelation and references to these explanations are sometimes cited in publications. I was a little annoyed to hear it on the radio again yesterday. The Church was apologizing because apparently over-enthusiastic members had performed temple ordinances for recently-departed Jews, AGAIN! This time the situation was particularly egregious because the Jews involved are the parents of the late Nazi-hunter and war-crimes expert Simon Wiesenthal. Can those who keep submitting these names stop already?
Exploring Romney’s Tax Return
Like most people who’ve looked at Romney’s return, I have to say: there’s nothing terribly interesting there.
Okay, let me walk that back: there’s a lot of hugely interesting things, if you’re interested in all the many ways a person can earn income, and all the many forms a taxpayer has to fill out when the taxpayer is broadly invested. Still, there are a couple things that I thought I’d highlight:
A Romney Tax Return Placeholder Post
Right now, I have 200+ pages of Mitt Romney’s 2010 tax return clogging up my work printer. He’s a Mormon, it’s a tax issue, I’m a tax guy, so there will clearly be a blog post in the near future. Unfortunately, I also have a job and a family and obligations (and did I mention it’s 200+ pages?), so that post may or may not happen in the next couple days. I’ve glanced through really quickly and, even though it’s fascinating, there doesn’t seem to be anything terribly surprising (his effective rate’s a little lower than I expected, but not much). Still, if there’s anything you’re curious about regarding his tax returns, please feel free to leave questions in the comments; I’ll try to answer them in my next post. As you leave comments, though, remember our comments policy. Specifically, don’t insult each other, don’t call Romney’s (or anybody else’s) personal righteousness into question, and, in general, play nice. And enjoy the look into a world of personal finance most of us rarely see.
Mitt Romney’s Tithing Problem (?)
ABC broke the news: Mitt Romney has donated millions of dollars worth of stock to the Mormon church. SEC filings disclose that a Bain partner donated $1.9 million of Burger King stock to the Church; in addition, the Church has received stock of other Bain holdings, including Domino’s, DDi, Innophos, and the parent company of AMC Theaters.
But why? Why would Romney give the Church equity stakes in bad fast-food chains, second-rate pizza chains, and other such holdings?
Sex-Ed and Social Justice*
***WARNING: This post mentions sex. I use the word a lot in this post. If that makes you uncomfortable, this may not be the post for you.*** Over the summer, the Bloomberg administration announced that, for the first time in two decades, public school students in New York would be required to take sex-ed. The curriculum the administration recommended—HealthSmart (middle school and high school) and Reducing the Risk—include, among other things, lessons on abstinence and birth control.

Harold Bloom, the Byrds, and Me
About a week ago, James posted a reflection on Harold Bloom’s (frankly awful) New York Times op-ed. Rather than directly responding, though (other than expressing his rightful disappointment), James engaged with Dr. Bloom’s allegation that Mormonism and Protestantism are converging. Though concerned about such a convergence, James ultimately (and rightly, I believe) doesn’t think we’re headed inexorably down that path. That said, Dr. Bloom is right that the Church has changed a lot between 1844 and 2011.[fn1] Change is inevitable and, as Ecclesiastes tells us, is to be expected. And, frankly, there have been a number of changes that, even if they risk our Protestantization, I’m really happy about. And I’m not talking Official Declaration 1 or 2 stuff—I’m going to assume that most of us are grateful that polygamy is no longer the sine qua non of the faithful member, and that all of us are grateful that we don’t live in the world of a racially-based Priesthood ban. And I’m also not talking about our wishlist of things we want changed. I assume most of us have one or two, even if they’re just wouldn’t-it-be-nice-if kinds of things. No, I’m talking about less-prominent practices that the Church once had that have left. Black Friday
Yes! The Dow is back down to 11,232! I feel a little like Jonah sitting on the hill, waiting for the fireworks. Hearing that news on the radio brought me my biggest smile all day. Of course, Jonah was roundly rebuked, because Nineveh repented in ashes, and he still was annoyed they weren’t destroyed. He clearly had an attitude problem, and lots of people might say the same about me. The Super Committee’s lame punt is just the most recent sign of the overall trend, though: at an institutional level, we haven’t even really admitted there is a problem, let alone started repenting. What do we need to repent of? Oh, there are plenty of things seriously wrong with the way we run our economy, including many of the favorite criticisms from both the right and the left, and the economy feeds into a lot of other things that are wrong with our society. I’ll just mention debt for now. We borrowed like mad for the past fifteen years or so, on houses, credit cards, student loans, and government programs, and called it prosperity—short-sighted materialism (among other things), masked and rationalized with convenient economic pseudo-theory. I was getting nervous about this back around 1999, but by now a lot of readers will probably grant it to me, though there are plenty of theorists and politicians who say our problem is still that we need to spend more. A Missionary Reminiscence on Christmas
When the mission president announced to our small group of greenies that I was going to Strasbourg, I shrugged the resigned shrug of a missionary who knew nothing about anywhere but was willing to go wherever. One of the sisters expressed jealousy; Strasbourg, she said, was one of the best cities in the mission. She was right, and it would not be a good thing. Strasbourg is and was beautiful pre-Christmas.* Several weeks passed before I fully acclimatized to the major time-change, and the schedule of missionary life, but I loved Strasbourg almost instantly. The eastern area of France bordering Germany is known as Alsace, and offers the best of both countries in terms of food, architecture, and other things. Parks are plentiful, the accent is easier to master, and doner kebab is cheap. Two wards meeting in an actual chapel with a basketball court were staffed by over a dozen hard-working missionaries who made me feel welcome as we did splits. My trainer, a stand-up guy, introduced me to the endless variety of bread, cheese, pastries, roasted chestnuts, and other delights as the weather cooled. On Saturdays, we played ultimate frisbee and soccer with other missionaries and ward members. Things were happening in the ward; we had at least one solid person we were teaching regularly, who came often and participated more than some members. Why Bloom, et al are wrong
Harold Bloom’s recent NY Times article on Mormonism & politics was tremendously disappointing. The sheer volume of poorly (or dishonestly) researched writing on Mormonism this season is exhausting; and to get this sort of long worn-out, conspiracy minded expression of clichés from someone as well educated as Bloom is downright disheartening[1] (though to be fair, we’ve gotten a good deal of serious journalism as well). But I’m actually not much interested in that side of Bloom’s article. Let me quickly bring up two other points from the article. First, Bloom states this: The founding prophet Joseph Smith[’s]…highly original revelation was as much a departure from historical Christianity as Islam was and is. But then, so in fact are most manifestations of what is now called religion in the United States, including the Southern Baptist Convention, the Assemblies of God Pentecostalists and even our mainline Protestant denominations. We could take note here – it’s a succinct and accurate response to those who criticize us in this vein. Next, I’d like to use Bloom as a way into a much more worrisome point – that is, a point that I worry a good deal about. The Forbes Shuffle
Forbes’ annual look at the 400 richest Americans was released last month, so I thought I would again take a look at the Mormons on the list, and was surprised to find a different Mormon on top of the list. Aaron B. claimed last May that Steven Udvar-Házy is LDS, and I have been able to verify that at least his wife is from an LDS family. Udvar-Házy now tops the Mormons on the Forbes list.
How Are You Celebrating?
No, today isn’t a national holiday. It’s not any particular religious festival. We’re more than a week away from Halloween, a month from Thanksgiving, and a couple months from Christmas. The only reason you have today off (assuming you have today off) is because today is Saturday. And yet . . . On October 22, 1986, President Ronald Reagan signed into law the Tax Reform Act of 1986, a bipartisan bill. That law, signed 25 years ago today, was the last fundamental tax reform in which the U.S. has engaged. Among other things, it broadened the tax base, reduced the number of tax brackets, and reduced the highest tax bracket from 50 percent to 28 percent. It vastly simplified the monster that the tax code had become. Since 1986, of course, the number of tax brackets has crept up, top marginal rates have crept up, and plenty of loopholes and special exceptions have been reintroduced into the tax law; we are arguable at a point where we again need to fundamentally rethink the tax law. The politics of the Tax Reform Act of 1986 are absolutely fascinating. If you want to peer into the political machinations of D.C., you could do worse than reading Birnbaum and Murray’s Showdown at Gucci Gulch, a comprehensive (and fascinating) look at the people who shepherded tax reform through the process. Do Mormons Get a Seat at the Table?
I just started reading the recently published Tri-Faith America: How Catholics and Jews Held Postwar America to Its Protestant Promise, by Kevin M. Schultz (OUP, 2011). With Mitt Romney’s Mormon-ness continuing to be an oddly fascinating topic for the mainstream media, a point of criticism and ridicule for journalist comedians (they think they are journalists, I think they are comedians), and a strategic weakness to be exploited by Rick Perry and possibly other candidates, Tri-Faith America seems like a very timely book.
Background: Elder Oaks and the Charitable Deduction
Yesterday, as Marc pointed out, Elder Oaks testified in front of the Senate Finance Committee in favor of the deduction for charitable giving. He argued that the charitable deduction is vital to the nation’s welfare. Why, though, these hearings on the charitable deduction? Is it under attack? In case you haven’t been following the politics of tax and budgeting recently (of course, who hasn’t?), I thought I’d provide a little background to the hearing. The Deduction for Charitable Donations The charitable deduction is an itemized deduction (more on that later). It’s one of the older deductions in the tax law, though its run is not coterminous with the tax law. The modern federal income tax was enacted in 1913, but the charitable deduction didn’t manage to get enacted until 1917. And what is the relevance of a deduction? Basically, a deduction reduces your tax liability by the amount of your deduction times your marginal tax rate. So, for example, if you pay taxes at a marginal rate of 35%, and you get a charitable (or any other) deduction for $100, you will pay $35 less in taxes than you would have without the deduction. If, on the other hand, you pay taxes at a 20% marginal rate, your tax bill would be reduced by $20. Itemization And what is an “itemized” deduction? I’ve been looking at Google’s ngram viewer this weekend, at the instigation of my fellow blogger, Wilfried Decoo, and what I came across implies that the “Mormon Moment,” starting in this case with Mitt Romney’s first run for the presidency, may have had a larger impact in places outside of the U.S. than it has had in the U.S.
All the Single Mormons
I wouldn’t be shocked if, in April’s General Conference, I were to hear a reference to “All the Single Ladies,” the cover story of this month’s Atlantic. In spite of its utter not-Mormonness, Kate Bolick’s article is oddly resonant of a strand of discourse we’ve been hearing in the Church for the last several years. In case you haven’t read the article,[fn1] a quick summary: the author finds herself still single at 39, in spite of having had plenty of relationships and in spite of the fact that she expected, at least for some portion of her life, to get married eventually (she points to 30 as the magic age). Now, she finds it less likely. So she explores the world of women who do not (by choice or circumstance or some combination) get married.[fn2] And largely she believes the decline in marriage is because of women’s increasing success, men’s declining status, and the marriage market. How’s that, exactly? Let’s use her college example: in 2010, 55 percent of college students were women. That means that women have fewer choices of suitable mates. Men in college, on the other hand, have more suitable women. A man, therefore, is less dependent on any given partner because, if she doesn’t work out, he’s got other potential partners. Therefore, he doesn’t need to settle down with just one person. Women, on the other hand, are at a disadvantage—in order to get (and maybe…

I should probably be responding to General Conference, given the timing and what I’ve been reading recently. And I still plan to respond to a couple of Conference issues. But the many recent news stories about Jobs has got me thinking about that instead. As I’ve pondered Jobs I think there is an important distinction that we are missing.
Free Your Pulpit
On Sunday, as we luxuriated in General Conference (however we followed it), we missed an annual tradition: Pulpit Freedom Sunday.[fn1] A quick background on Pulpit Freedom Sunday: on July 2, 1954, Lyndon Johnson proposed that Section 501(c)(3) (the Internal Revenue Code section that exempts, among other things, churches, universities, and the NCAA from tax) be amended to prevent exempt organizations from campaigning on behalf of or against candidates for office. [fn2] There’s no legislative history, and, in fact, no record of the voice vote on the amendment. But it passed. Note, though, that the prohibition wasn’t particularly aimed at churches; in fact, most people seem to think Sen. Johnson was worried that (non-religious) nonprofits were trying to unseat him. Since 2008, the Alliance Defense Fund has sponsored Pulpit Freedom Sunday. The basic idea is that pastors flout the prohibition, deliberately supporting or opposing a candidate for office in their sermons. Which they record. And send to the I.R.S. The idea seems to be to “bait” the I.R.S. into attempting to revoke at least one church’s tax exemption, then challenge the revocation to the Supreme Court, in an effort to have the prohibition overturned as unconstitutional. Will the I.R.S. take the bait? Probably not. In 2006, the I.R.S. released a study it had done of its 2004 Political Activities Compliance Initiative. Basically, it looked at 82 cases in which it the non-profit allegedly violated the prohibition.[fn3] It determined that 18 of the…
The Church and Taxes
The Church cares about taxes.[fn1] It doesn’t really seem to care about the details of tax policy, of course. I’ve never seen the Church weigh in on the appropriate tax rate, tax base, or even the appropriate type(s) of tax (e.g., an income or consumption tax, a retail sales tax or a VAT, or whatever) a government should impose.[fn2] But still, it makes explicit and implicit nods that indicate that, ultimately, it cares both about its tax position and that of its members. The Church and (Its) Taxes Like (essentially) every other church in the U.S., the LDS church is exempt from taxation. Not only that, certain U.S. taxpayers who donate to the Church[fn3] can deduct their donations. And the Church is careful to protect its tax exemption. It explicitly does not endorse or oppose candidates for office.[fn4] Church property cannot be used for doing things that would endanger the Church’s tax exemption. It organizes its for-profit businesses as separate, non-exempt corporations.[fn5] So the Church wants to maintain its exemption. Note, though, that the exemption benefits not only the Church, which doesn’t have to pay taxes, but its (U.S., but see below) members, who might get a deduction for their donations. Note, too, that even if the Church lost its exemption, it probably wouldn’t be taxable on donations it received; they would likely (though not unquestionably) be treated as non-taxable gifts. One of the gloriously enriching experiences in marriage – at least in my marriage – is all of the truly wonderful people that my wife has brought into my life. One of these persons is Sarah Bringhurst Familia – a brilliant, homeschooling mother, who also happens to be a pillar of global citizenship. Since marrying, she and her husband have lived in a number of exotic locations, including Utah, California, The Philippines, Ireland, Italy, and most recently Tunisia. With both a degree and lots of life experience centering around the Middle East, she’s a trenchant observer of current affairs in the region. Desperately Seeking Seniors
I was surprised a week ago when a senior missionary serving in our ward said that the Church is struggling to get senior missionaries, something that an article in the Deseret News last week confirmed. But my senior missionary friend went further than the article did, saying that the number of senior missionaries has declined by 40% in the past decade.
Desert and a Just Society
The 2010 poverty level in the U.S., we learned on Tuesday, is the highest it has been since 1993. In 2010, about one in six Americans lived below the poverty line.[fn1] In June, 14.6% of Americans received food stamps.[fn2] To some extent, the high poverty rate is probably related to the high unemployment rate, which was 9.1% in August. I throw out all of these numbers to suggest that, as a society, we have a problem. That problem needs to be fixed. And we, as Mormons, undoubtedly have something that we can bring to the discussion of how to fix it. As I think about how we can fix poverty, though, I’m hugely influenced by Ron Haskins and Isabel Sawhill’s book Creating an Opportunity Society.[fn3] Haskins and Sawhill point out that Americans care about desert.[fn4] That is, as Americans, we want those who have the ability to work for a living. And I’m interested in this idea of desert. Because I’m not convinced that we have a religious dispensation to withhold assistance from those don’t somehow “deserve” our help.[fn5] Still, as a practical matter, irrespective of whether we have religious dispensation or not, we care about desert. And no social program that is blind to to recipients’ refusal to work is going to go anywhere. As a pragmatist, then, I have to confront desert. But, as we consider how to provide aid to those to whom we have the political…
Mormonism and Social Justice
Recently, we’ve seen some distrust of religions that advocate social justice, from sources as diverse as the political punditry and lay Mormons.[fn1] The criticism is unfounded, of course, and strikes me as ahistorical and anti-Catholic. The term “social justice” comes from 1840, when the Jesuit scholar Luigi Taparelli as he worked through the philosophy of Thomas Aquinas. As you look at Jesuit schools’ mission statements, you begin to understand how central social justice is to the Jesuit identity. I teach at a Jesuit law school. Part of our mission is to “prepare graduates who will be ethical advocates for justice and the rule of law.” This social justice emphasis is inspired by the belief that each human being “deserves dignity and respect.” And Pope Benedict XVI takes this dessert further: he says that charity is inseparable from justice.[fn2] So why spend this time, on a Mormon blog, talking about Catholic conceptions of social justice? Because not only does the Mormon tradition has the same biblical and traditional Christian justifications to pursue a just society,[fn3] but Restoration scripture and modern prophets provide additional impetus.[fn4] That is, as Mormons, we have a duty to pursue a just society. Recognizing this duty doesn’t, of course, define the contours of a just society, or prescribe the route we use to arrive at this just society. We still need to ask what and how. Neither is a simple question, and I don’t have an overarching vision for what…
